If you intend to set up a User Account and use our services, you will be asked to provide us with your personal information.
Your data is processed by us for the purposes set out below, related to the functioning of the Store and the provision of services offered in it ("Services").

We will process your data only for the period in which we will have a legal basis, and thus until:

§ 1 Definitions
Working days - days from Monday to Friday, excluding public holidays.
Account - a free store function regulated by separate regulations (service provided electronically), thanks to which the Buyer can set up his individual Account in the Store.
Consumer - Consumer within the meaning of the Civil Code.
Buyers - every entity purchasing in the Store.
Regulations - these regulations.
Shop - Kosa Collection online store run by the Seller at https://kosacollection.com.

§ 3 TECHNICAL REQUIREMENTS
For the proper functioning of the Store you need:
• A device with access to the Internet
• Internet browser that supports JavaScript and cookies.
2. For placing an order in the store, in addition to the requirements set out in paragraph 1, an active e-mail account is required.
§ 4 SHOPPING IN THE STORE
1. The prices of goods visible in the Store are total prices for the goods, including VAT.
2. The Seller points out that the total price of the order consists of the price indicated in the Store: the price for the goods and, if applicable, the costs of delivery of the goods.
3. The item you want to buy should be added to the bag in the store.
4. Then, the Buyer selects from the available in the Store: the way of delivery the goods and the payment method for the order, and also provides the data necessary to complete the order.
5. The order shall be made at the time of confirmation of its content and accept the terms and conditions by the buyer.
6. Placing an order is the same as concluding a sales contract between the Buyer and the Seller.
7. The Seller shall provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium at the latest at the time of delivery of the goods.
8. The buyer can register in the Store, i.e. set up an Account in it or make purchases without registration by providing his data with every possible order.
§ 5 PAYMENTS
1. The order may be paid, depending on the Buyer's choice:
a. A simple transfer to the Seller's bank account.
b. By means of a payment card:
• Visa
• Visa Electron
• MasterCard
• MasterCard Electronic
•Maestro
c. Through the payment platform:
• PayU
d. On delivery, i.e. cash on delivery to the Buyer.
e. Cash when pick up personally.
2. If the Buyer selects advance payment, the order must be paid within 1 business day of placing the order.
3. The Seller informs that in the case of some payment methods, due to its specificity, the order payment is possible only directly after placing the order.
4. By purchasing at the Store, the Buyer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance.
§ 6 ORDER COMPLETION
1. The Seller is obliged to deliver goods without defects.
2. The date of the order is indicated in the store.
3. In case that the Buyer has chosen advance payment for the order, the Seller will proceed with the order after its payment.
4. In a situation where, under one order, the Buyer purchased goods with different delivery dates, the order will be processed within the deadline for the goods with the longest term.
5. The goods are delivered exclusively on the territory of the Republic of Poland.
6.Goods purchased in the Store are delivered depending on Buyer’s delivery method the Buyer:
a. Via the courier company
b. Through Poczta Polska
c. For InPost parcel machines
7. The buyer may pick up an order at the company's office during the opening hours.
8. If you select personal reception by the Buyer, the goods will be available for collection at the indicated date of order fulfillment, in the case where the seller has pointed out the term of dispatch of the goods-in this period.
§ 7 RIGHT of WITHDRAWAL
1. The consumer shall be entitled to withdraw from the contract concluded with the seller through the store, subject to § 8 of the Terms, within 14 days without giving any reason.
2. The cancellation period will expire after 14 days from the date of:
a. where the consumer took possession of the goods or where the third party other than the carrier and indicated by the consumer came into possession of the goods.
b. where the consumer took possession of things or a third party, other than the carrier and indicated by the consumer, came into possession of the things in the case of a contract which commits to transfer ownership of the many things that are supplied separately.
c. conclusion of the contract-in the case of a contract for the supply of digital content.
3. That the consumer can exercise the right of withdrawal from the contract must inform the seller, using the contact details provided in § 2 of the Terms, of its decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post or information communicated via email).
4. The consumer can make use of the model withdrawal form placed at the end of Terms, but it is not mandatory.
5. To keep the deadline to withdraw from the contract, it is sufficient for the Consumer to send information concerning the exercise of his right of withdrawal from the contract before the expiry of the deadline to withdraw from the contract.
CONSEQUENCES OF CONTRACT WITHDRAWAL
6. In case of cancellation of the contract the seller returns the consumer all received payment from him, including the cost of delivery of the goods (with the exception of additional costs arising from the selected by the consumer how to supply other than the cheapest regular delivery method offered by the seller), promptly, and in any event not later than 14 days from the date on which the Vendor has been informed of the decision of the consumer of the exercise of the right to withdraw from the contract.
7. Reimbursement of payment the seller will make using the same payment methods that have been used in the original transaction by the consumer, unless the consumer agrees otherwise, in each case, the consumer does not incur any fees in connection with this phrase.
8. The seller may withhold the reimbursement until receipt of the goods or deliver proof of his return, depending on which event comes first.
9. The seller asks you to return the goods to the address: ul. Ołowiana 12, 85-461 Bydgoszcz immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller about the withdrawal from the sales contract. The deadline is met if the consumer sends back the goods before the expiry of the 14-day period.
10. The Consumer shall bear the direct costs of returning the goods.
11. The consumer is responsible only for a reduction in the value of the goods resulting from the use of it in a different way than it was necessary to establish the nature, characteristics and functioning of the goods.
12. If the goods due to their nature cannot be returned in the ordinary course of post Consumer also will have to bear the direct cost of returning the goods. Estimated amount of these costs the consumer will be informed by the seller in the description of the goods in the store or when placing the order.
13. If there is a need to return transaction funds made by the Consumer with a payment card, the Seller will refund it to the bank account assigned to that payment card.
§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAW THE CONTRACT
1. The right to withdraw from the contract concluded at a distance shall not be entitled to the consumer in respect of contracts:
a. Where the object of the service is prefabricated, manufactured according to the specifications of the consumer or for satisfaction of his individualized needs.
b. Where the object of the service is to prone to deteriorate or having a short shelf life.
c. Where the object of the service is the thing supplied in sealed packaging, which after opening the package cannot be returned due to health or hygiene reasons, if the packaging has been opened after delivery.
d. the benefits are things that after delivery, due to their nature, are inseparably combined with other things.
e. where the object of the service are sound or visual recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery.
f. Providing newspapers, periodicals or magazines, with the exception of a subscription agreement.
g. Where the price or remuneration depends on fluctuations in the financial market, over which the trader has no control, and which may occur before the deadline for withdrawal from the contract.
h. To provide digital content that is not stored on a durable media, if the performance began with the Consumer's explicit consent before the deadline for withdrawal and after informing the trader about the loss of the right to withdraw from the contract.
2. The right to withdraw from a distance contract is not available to an entity other than the Consumer.
§ 9 CLAIMS
In case of defects in goods, the buyer has the opportunity to advertise a faulty product on the basis of a regulated in the civil code or the guarantee, unless the warranty is granted.
2. Using the warranties, the buyer may, on the basis of and within the time limits set out in the civil code:
a. make a statement about the price reduction
b. in defect of material-make a statement of withdrawal from the agreement
c. demand an exchange of things for free from defects
d. Request removal of the defect
3. The seller asks you to claim on the basis of the warranty to the postal address or electronic indicated in § 2 of the Terms.
4. If it is found that for complaint, it is necessary to provide your goods to the seller, the buyer is obliged to deliver the goods, in the case of the consumer at the expense of the seller at the address ul. Ołowiana 12, 85-461 Bydgoszcz.
5. If the product has been granted in addition, warranty, information about it, and about its conditions, is available in the description of the product in the store.
6. Complaints regarding the operation of the store should be directed to the email address indicated in § 2 of Terms.
7. Consideration of the complaint by the seller will be within 14 days.
OUT-OF-COURT COMPLAINTS AND ASSERTION OF CLAIMS
8. Where complaints do not bring expected by the consumer, the consumer can use m.in. with:
a. mediation conducted by the competent Provincial trade inspection Inspectorate dispose, to which to apply the request for mediation. As a general rule, the procedure is free of charge. List of the inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
b. Aid proper dispose amicable consumer court acting at the provincial inspectorate of trade inspection, to which you should apply for a review before the arbitrator. c. Urban aid or the District Attorney consumers.

§ 10 PERSONAL DATA
1. Administrator of personal data provided by the Buyer when you use the store is the Seller. 2. The buyer's personal data are processed on the basis of a contract and to its implementation, in accordance with the principles laid down in the general regulation of the European Parliament and of the Council (EU) data protection (GPRD). § 11 OBJECTIONS
1. The Buyer is forbidden to provide illegal content.
2. Each time the folding in the store order is a separate sales agreement and requires a separate acceptance of the rules of procedure. The agreement is concluded on time and in order to carry out the order.
3. agreements concluded under this Term shall be concluded in the Polish language.
4. In the event of a dispute with a buyer non-consumer the competent court will be the court competent for the registered office of the Seller.
5. Nothing in these terms shall exclude or in any way restrict the rights under consumer law.
6. The provisions concerning goods shall apply appropriately to the digital content, unless the rules of procedure does not specify these issues separately.
